Jenis penelitian ini merupakan penelitian kualitatif dengan Teknik pengumpulan data melalui studi kepustakaan (library research). Penelitian ini menunjukan bahwa ketentuan iddah pada kitab an nikah bertujuan untuk memastikan kekosongan rahim perempuan setelah terjadinya talak raj’i. Ketentuan masa iddah diatur dalam kitab an nikah seperti iddah talak raj’I, iddah wath’I, iddah hamil, iddah bagi perempuan merdeka, perempuan budak, iddah wanita menopause, iddah lansia serta ketentuan rujuk pada masa iddah. Menurut syekh Arsyad al Banjari, syarat sah rujuk pasangan suami istri ialah dengan mengucapkan lafal rujuk secara sharih dari suami kepada istrinya. Dalam kitab an Nikah tidak hanya mengatur mengenai ketentuan masa iddah, tetapi juga mengatur dampak yang terjadi akibat wath’I terhadap nasab atau keturunan. It is closely tied to health, hygiene, and spiritual well-being, making it an integral part of the community's identity and local wisdom. This tradition involves the use of herbal steam to cleanse the body, which is believed to offer benefits not only for physical health but also for mental and emotional well-being. The purpose of this study is to examine the batimung tradition through the lens of maqashid sharia, as outlined by Al-Syathibi, which emphasizes the preservation of five key objectives of Islamic law: religion, life, intellect, lineage, and wealth. Employing a qualitative descriptive-analytical approach through a literature review, the study highlights how batimung aligns with the principle of hifz an-nafs (protection of life) by promoting physical and mental health. Furthermore, its spiritual aspects reflect Islamic values, such as the emphasis on cleanliness as part of faith and efforts to maintain a balanced life. The findings underline that batimung is not merely a local tradition but also a practice imbued with dimensions of maqashid sharia. Even though the rules for registering marriages are contained in Law no. 1 of 1974 and the Compilation of Islamic Law, but on the other hand, obedience to religion is still ingrained in the flesh so that the existence of sirri marriage is a solution so as not to violate other Islamic laws. Grujugan? b) Islamic law perspective on the phenomenon of unregistered marriage as an alternative to the problem of sharia violations during the sermon period in Kejawan Village, Kec. Grujugan? This research is a type of field research using descriptive qualitative methods. The results of this research: a) the implementation is a traditional and traditional wedding in the village. By presenting religious figures at the Sirri wedding as a solution to avoid violations of the Sharia. B). This research is included in qualitative research with data collection carried out through library research by referring to books, journals and other scientific works. This study aims to analyze the Bausung Pegantin Tradition in the Community reviewed from Islamic Law. The Bausung Pengantin tradition is one of the unique processions in Banjar traditional weddings in South Kalimantan, where the bride and groom are carried on their shoulders by two men. Despite the potential risks, this tradition is still carried out as a form of respect for ancestors and as a symbol of social status. From the perspective of Islamic Law, this tradition does not contradict as long as its implementation does not damage the conditions and principles of marriage. This research also highlights the benefits caused, including cultural preservation and increased public enthusiasm for marriage. Jujuran berbeda dengan mahar. Jujuran biasanya lebih besar dari mahar, karena fungsi jujuran adalah sebagai bantuan untuk melaksanakan resepsi perkawinan dan juga untuk modal awal berumah tangga. tradisi ini memiliki dampak-dampak psikologis bagi calon pengantin terutama dari pihak yang memberi yaitu pihak laki-laki. It is an offering of raw materials consisting of rice, palm sugar, coconut, eggs, thread, and needles. Typically, it is placed beneath the stage during the wedding celebration with the hope that the event will proceed smoothly. This tradition is believed to ward off misfortune and protect against evil spirits that may disrupt the wedding. This study aims to examine the maqasid shariah perspective, according to Al-Syathibi, on the piduduk tradition in Banjar customary marriage. The method used in this research is normative or library research, reviewing literature to analyze the relevance of this tradition in the context of Al-Syathibi’s maqasid shariah, which focuses on the primary objectives of shariah: preserving dharuriyyat (essentials), hajiyyat (complementary needs), and tahsiniyyat (embellishments). The results of this study indicate that, from the perspective of maqasid shariah as outlined by Al-Syathibi, the piduduk tradition in marriage falls under the category of al-maslahat tahsiniyyat (tertiary benefits). The tradition contains positive values, such as obeying parental instructions, giving charity, and preserving local cultural heritage. In marriage, having a guardian for the bride and groom is one of the pillars of marriage. Where in a marriage a guardian is taken from the father's side and is called a nasab guardian, it is the nasab guardian who has the right to be the guardian in the implementation of the marriage. A girl who is only registered as her mother's daughter, she has no blood relationship with her biological father. Directly, the child does not have a lineage guardian, because the lineage guardian is taken from the father's lineage, so the marriage registrar refuses to marry him off, because he does not have a mujbir guardian. Based on this problem, the author is interested in researching how marriages are resolved for women who are only related to their mother and who do not have a direct line to their biological father and what faktors cause them to be registered as the mother's child. In the research that will be carried out, the author chose a location in Grujugan District, Bondowoso Regency. This research is a type of field research using qualitative methods. The results of this research are the implementation of child marriages that are related to their mother only, so the marriage uses a guardian judge instead of the guardian of the lineage, with a decision from the Religious Court in determining the guardian judge. The research focuses on comparing Syekh Muhammad Arsyad al-Banjari's views on the order of marriage guardians with the opinions of scholars from other Islamic jurisprudential schools (mazhab). The methodology employed in this study is qualitative, centered on a literature review utilizing various sources, including manuscripts, books, journals, newspapers, and other documents. The primary focus of the study is the Kitab An-Nikah, written by Syekh Muhammad Arsyad al-Banjari, which serves as the main object of analysis to explore the concept of the order of marriage guardians as elaborated in the text. The findings reveal that Syekh Muhammad Arsyad al-Banjari's thoughts on marriage guardianship are closely tied to the social context of the Banjar community, which predominantly adheres to the Shafi'i school of thought. In this context, marriage is regulated by conditions and pillars that include the existence of a guardian as an important element to ensure the validity of the marriage contract. The guardian acts as a protector and granter of permission for the bride, as well as maintaining the blessings of marriage according to Islamic law. The existence of witnesses in the marriage contract is also a requirement for the validity of the marriage, where the witnesses are tasked with maintaining transparency and ensuring justice in the marriage. On the other hand, the book Kitabun Nikah by Sheikh Muhammad Arsyad Al-Banjari explains the legal aspects of marriage in Islam, including the role of guardians and witnesses, as well as the requirements for the validity of the marriage. The research method used in this study is a literature study, which examines various relevant sources to provide an in-depth understanding of this topic. This literature study not only provides a strong theoretical foundation, but also highlights research gaps and previous research contributions.
