<p><em>This study aims to determine (1) the concept of fraud in Islamic law and positive law (2) Islamic law's view on online fraud and fraud sanctions in Islamic law and positive law. This type of research is Library Research (library research) with a normative legal approach. The source of research data is in the form of primary and secondary legal materials. The data collection technique is by document study method. The data analysis technique uses content analysis and comparative analysis. The concept of criminal acts of fraud or "bedrog" contained in Article 378-395 of the Criminal Code Chapter XXV is fraud in the broad sense, while Article 378 of the Criminal Code mentions the term "oplichting" which has the meaning of fraud in the narrow sense. Online-based fraudulent buying and selling is an act that violates the law and has been determined as a criminal act because it has met the elements contained in Article 378 of the Criminal Code and Article 28 paragraph 1 and Article 45 paragraph 2 of the ITE Law. A maximum of six years in prison and a fine of one billion rupiah. In Islamic Criminal Law, the penalty for online fraud is a punishment for a violation or crime that is not regulated in had. This punishment varies according to the differences in the case and the perpetrator. From one aspect, this ta'zir is in line with the had punishment, namely an action taken to improve human behavior, and to prevent others from committing the same action.
