TINJAUAN HUKUM EKONOMI SYARIAH MENGENAI TRANSAKSI JASA FREELANE DENGAN SKEMA ESCROW DI PLATFORM DIGITAL SRIBU

This study aims to examine freelance service transactions using the escrow scheme on the Sribu digital platform from the perspective of Sharia Economic Law. The escrow scheme is a mechanism in which a third party holds funds until the work is completed in accordance with the agreed terms. This study employs a qualitative method with a normative approach through library research. The data were obtained from the Qur’an, hadith, DSN-MUI fatwas, books, scientific journals, and classical and contemporary Islamic jurisprudence literature, and were analyzed using descriptive qualitative analysis. The findings indicate that freelance service transactions fall under the ijarah contract, while the escrow mechanism can be examined through the concepts of wakalah bil ujrah in fund management and wadiah in temporary fund safekeeping. In principle, this scheme is permissible under Sharia Economic Law, provided that the pillars and conditions of the contract are fulfilled, the service object, payment, and rights and obligations of the parties are clearly defined, and the transaction is free from riba (usury), gharar (excessive uncertainty), maisir (gambling), and injustice. Therefore, freelance service transactions using the escrow scheme on the Sribu platform may be considered consistent with Sharia principles when conducted transparently, fairly, and based on clear mutual agreement.
