TINJAUAN HUKUM EKONOMI SYARIAH TERHADAP SISTEM BAGI HASIL AKAD MUZARA’AH ANTARA PEMILIK SAWAH DAN PENGGARAP SAWAH

Abstract

This study examines the implementation of the muzara’ah profit-sharing system between landowners and agricultural workers at Nurul Qarnain Islamic Boarding School, Jember, from the perspective of Islamic Economic Law. This study aims to determine the mechanism of the muzara’ah contract and analyze its conformity with the principles of Islamic Economic Law. The research employed a qualitative method through field research using an empirical juridical approach. Data were collected through observation, interviews, and documentation, and analyzed through data reduction, data presentation, and conclusion drawing. The findings indicate that the muzara’ah profit-sharing practice is implemented based on an agreement between the landowner and the agricultural worker, with the harvest distributed according to the agreed profit-sharing ratio. In principle, the practice fulfills the pillars and conditions of muzara’ah, including the contracting parties, the object of the contract, agricultural work, and profit-sharing. However, improvements are still needed regarding the clarity of the parties’ rights and obligations, the allocation of production costs, and written documentation of the agreement. Therefore, the implementation of muzara’ah at Nurul Qarnain Islamic Boarding School, Jember, is generally in accordance with Islamic Economic Law and reflects the principles of justice and public benefit, although its administrative aspects need to be strengthened.
