ANALISIS KETENTUAN URUTAN WALI NIKAH PERSPEKTIF SYEKH MUHAMMAD ARSYAD AL-BANJARI

Abstract

This study examines the provisions regarding the order of marriage guardians (wali nikah) from the perspective of Syekh Muhammad Arsyad al-Banjari, a prominent scholar from South Kalimantan who played a significant role in the development of Islamic law in the Banjar region. The research focuses on comparing Syekh Muhammad Arsyad al-Banjari's views on the order of marriage guardians with the opinions of scholars from other Islamic jurisprudential schools (mazhab). The methodology employed in this study is qualitative, centered on a literature review utilizing various sources, including manuscripts, books, journals, newspapers, and other documents. The primary focus of the study is the Kitab An-Nikah, written by Syekh Muhammad Arsyad al-Banjari, which serves as the main object of analysis to explore the concept of the order of marriage guardians as elaborated in the text. The findings reveal that Syekh Muhammad Arsyad al-Banjari's thoughts on marriage guardianship are closely tied to the social context of the Banjar community, which predominantly adheres to the Shafi'i school of thought. This research is expected to contribute to the study of local Islamic law and provide new insights into the application of Islamic jurisprudence within the cultural context of the Nusantara region.
