HAK DAN KEWAJIBAN PARA PIHAK DALAM JUAL BELI ONLINE PERSPEKTIF HUKUM EKONOMI SYARI’AH
Abstract
Online shooping and selling transactions between the seller and the consumer do not meet directly and the consumer does not see directly the goods he will buy because he only sees the pictures and specifications listed in the online store so that sometimes the goods received by the consumer do not match the ordered. Not infrequently consumers feel harmed by under taker of busnis because under taker of busnis often provide less clear information about the goods, so there is a discrepancy between the goods ordered and the images provided by under taker of busnis that result in disappointment and consumer losses.
The research method used is the Syariah Economic Law Research method that advocates qualitative research options, covering data sources, both primary and secondary data. Data collection techniques are observations, interviews, and documentation. Data analysis techniques are data reductions, display data, verification. Checking the validity of the data, and the stages of research. All of these researchers use, to obtain the results of research.
Research Result: A.The responsibility of under taker of busnis in online shooping according to sharia economic law has two dimensions, namely vertical dimension and horizontal dimension, secondly dimensions can be identified as follows: the principle of tawhid, the principle of willingness, the principle of justice, the principle of honesty, the principle of freedom in the form of khiyar rights for consumers. B. Consumer obligations are not explained specifically in sharia economic law, but when looking at the purpose of regulation of consumer protection law (UUPK) article 5, for the benefit of consumers and under taker of busnis, then the regulation is in accordance with Islamic law and maqashid al-shari'ah, namely to realize mashlahah (goodness), including: Good faith in making transactions, Seeking information in various aspects of an item or service to be purchased or used Pay according to the price or value that has been agreed and based on mutual willingness.
