The phenomenon of unregistered (siri) marriage in Indonesia raises complex legal issues, particularly concerning inheritance rights of children born from such marriages. Prior to the Constitutional Court (MK) Decision No. 46/PUU-VIII/2010, children from unregistered marriages only had civil relations with their mothers and maternal families, without inheritance rights from their biological fathers. The Court’s decision affirmed that children born out of wedlock have civil relations with their fathers if biological links can be scientifically proven, such as through DNA testing. This study aims to analyze the implications of this decision from the perspective of maqasid al-syari‘ah, focusing on hifz al-nasl (protection of lineage) and hifz al-mal (protection of property). Using a normative juridical method combined with case and conceptual approaches, this study examines Constitutional Court Decision No. 46/PUU-VIII/2010, related legislation, and Islamic jurisprudence. The findings show that the Court’s decision aligns with maqasid al-syari‘ah principles by ensuring legal protection, lineage recognition, and economic justice for children born out of wedlock. Thus, it represents a form of constitutional ijtihad that harmonizes Islamic justice values within Indonesia’s legal framework.
