Abstract

Incestuous marriage is a form of marriage strictly prohibited under Islamic law because it involves a couple who are related by a mahram muabbad (permanently forbidden to marry). However, in practice, there are cases of incestuous marriages that occur unintentionally, for example due to ignorance of the couple's kinship status. This study aims to analyze the legal status of lineage and inheritance of children born from incestuous marriages according to Islamic jurisprudence (fiqh), specifically the Shafi'i and Hanafis. This study used a library research method with a normative and comparative approach. The analysis shows that both schools agree that incestuous marriages are categorized as fasid marriages and are considered syubhat (questionable marriages). Consequently, children born from such relationships retain a legitimate lineage relationship with their father and have the right to inherit from him and his father's family. This study emphasizes the importance of legal education on marriage in society to prevent marriages that violate Islamic law and to promote the protection of the rights of children born from such marriages without social stigma.
